Soloviov O. Application of the European Human Rights Convention and the case-law of the Strasbourg Court in Ukraine (general theoretical issues)

The dissertation is dedicated to theoretical research of crucial issues and trends related to the application of the European Human Rights Convention and the case-law of the Strasbourg Court in Ukraine. The applicability of the European Human Rights Convention as a formal source of law has been clarified and characterized as an integral part of the national legislation of Ukraine. Specific problems regarding the application of the Convention in Ukraine have been scrutinized. General and specific terms of the application of the Strasbourg Court case-law have been defined. The current situation in Ukraine has been studied and the ways to improve the statute regulating the application of the Strasbourg Court case-law in Ukraine have been identified.
