Miroshnichenko Y. Tactical and Organizational Bases of Judicial Trial of Criminal Cases.

The thesis is devoted to procedural, tactical and organizational problems of judicial trial of criminal cases. The author determines active role of the court in carrying out court action to obtain evidence based on the analysis of scientific works of native and foreign scientists and court practice. The author proves that tactic of judicial trial of criminal cases includes scientific bases of judicial tactic, tactic of court and tactic of prosecution. Judicial trial planning includes three stages: before previous case consideration by a judge, after the previous case consideration by a judge, during the judicial trial. Organization of judicial trial of criminal cases is auxiliary to judicial activity, which is di-rected on realization of the proper sequence of judicial and other procedural actions, providing of their efficiency and creation of favorable conditions. The features to consider tactics for court action - interrogations, crimescene investigation, presentation for identification, forensic examinations are properly researched. The author suggested supplementing the existing CPC of Ukraine by norms about some investigative actions, expert and specialist par-ticipations, rights of a victim, setting of examinations and other.
