The work comprehensively analyzes the legal status of railway transport employees. It provides definitions of terms "employee", "railway transport employee". In accordance with the specifics of labour functions it subdivides the category of railway transport employees into two groups: employees of the primary railway activity and employees of the secondary railway activity. The research thoroughly specifies the legal status of the employees of the primary railway activity as persons with a special legal labour status, in particular, it determines the specifics of their legal standing, essential rights and duties, as well as specific features their responsibilities and guarantees. The work identifies suggestions as to improving valid legislation in legal regulation of the special legal labour status of the employees of the primary railway activity, namely, it offers to adopt a special regulation "On the legal status of railway transport employees".
