The dissertation is the monography on examining the legal matters of criminal cases breaking due to the materials of operative and search events. Matters of legal regulation of procedural activity, cooperation of the investigator and operative officer, prosecutor supervision and trial control at the stage of solving the matters on criminal cases breaking. There is an analysis of current legislation, the result of prosecutor's and court practice on breaking and investigation of criminal cases in 2006-2009. The author has defined the irregular and disputable matter and determined the ways of their legal regulation.
