Dissertational research is devoted pressing questions which arise in the theory and manufacture practice on criminal cases with participation of the lawyer. Opening the legal nature and the maintenance of the right to protection, it is noticed that the granted right - the constitutional principle of the criminal trial which maintenance is set of the procedural rights given to the suspect, accused for protection against charge as personally, and by means of the chosen defender.
