Kuchynska O. The Principle of Justice as an Ethical and Legal Framework of Criminal Proceedings.

The dissertation is devoted to actual theoretical and practical problems associated with the necessity of the legislative consolidation of the principle of justice in criminal proceedings, identifies the shortcomings of legal mechanism of practical implementation of the mentioned principle in the activity of state bodies and officials, who carry out criminal proceedings, as well as forms the scientific-grounded proposals on that framework, aimed at improvement of criminal procedure legislation and practice of its application. Determinants of occurrence and operation of the principle of justice in criminal proceedings, the content of the principle of justice and its place in the framework of criminal proceedings are studied in this work. The current state of legal regulation mechanism of the principle of justice in criminal proceedings is analyzed. The legal mechanism of the mentioned principle on pre-trial stages of the criminal process as well as during the court proceedings of criminal cases and their sentencing is examined.
