Essay

The thesis is devoted to the complex analysis of legal regulation of the right to strike and lock-out in conditions of Ukraine's transfer to the market economy. It was determined that it is necessary to use a general notion in order to define differences between employee and employer, which cannot be disposed while negotiations concerning: (1) conditions of labour which are not covered in law or other legal acts; (2) application of labour legislation norms. It was proposed to define this notion as a conflict in the sphere of labour which comprises collision of interests and labour dispute.
