Dissertation is devoted to the theoretical and practical problems of application of administrative discretion in activity of Ministry of Internal Affairs. In the work it is studeid the concept of administrative discretion, it is generalized his understanding in science and practice. The current legislation which regulates application of administrative discretion in activity of Ministry of Internal Affairs is analysed, his grounds and signs are set. On the basis of complex research classification of administrative discretion is offered.
