Shirant A. The principles of the pension security.

The Thesis presents the complex research of the urgent theoretical problems as well as practical fulfillment of the pension security principles. The analysis of the special features of pension security category within the social security law (social/state pension security) has been made. The concept of the present pension security principles was researched in the context of their genesis. The analysis and estimation of the existing systems of social and pension security permits the author to formulate the system of conceptual (doctrinal) principles of present-day social (state) pension security. The great attention has been made to the research of the specific features and problems in realization of doctrinal social (state) pension security principles in the Ukrainian laws, and in the process of the judicial protection of the constitutional right of the person on pension security and during the process of pension security system of Ukraine reforming. On the basis of the present research the concrete proposals on improving of pension security legislation has been made, that permits to make acting pension security system better, to harmonize it with international legislation acts and to facilitate the effective introduction of the constitutional right of the person on pension security, including during its judicial protection.
