Mazur M. Defence of rights and legal interests of rehabilitated people in criminal procedure.

The dissertation is devoted to complex research of theoretical and practical problems of defence of rights and legal interests of people rehabilitated in criminal procedure of Ukraine. Existing scientific positions and legislation as to rehabilitation and a rehabilitated person in criminal procedure have been analyzed in the work. Complex research of rights and legal interests of the rehabilitated person has been carried out. Existing forms, methods and means of protection of rights and legal interests of rehabilitated people have been determined. Complex research of existing procedure of defence of rights and legal interests of rehabilitated people in Ukraine has been carried out. Based on the aforementioned a conclusion has been drawn that it is not sufficiently efficient, has normative contradictions and requires prompt changes. Legislative securing of the institute of rehabilitation in Criminal Procedural Code of Ukraine has been suggested and position on existing of exclusively judicial procedure of person rehabilitation has been grounded which will result in making a court decision in the form of resolution on rehabilitation. A number of suggestions and recommendations have been developed directed to improvement of defence of rights and legal interests of people rehabilitated in domestic criminal procedure.
