The dissertation is devoted to research of legal laws of realization by discretion court in administrative legal proceedings. The author researches the substantial legal laws of realization of court's discretion in this sphere. The basic scientific concepts concerning its essence are analyzed and classified.The notion of judicial discretion in administrative proceedings, its content and volume is defined. The function of judicial discretion in the specified area and its social purpose is exposed and analyzed. It is found out the legal nature and imperiously-regulative mechanism for the assignment of judicial discretion in administrative proceedings, its system is described, and the relationship between its constituent elements is investigated. The laws of functioning of this mechanism are defined.
