Pravdyuk V. Lands division of Ukraine at the purposed use in accordance with the legislation of Ukraine

The dissertation is dedicated to the study of legal nature of the purposed use of lands, problem issues of legal regulation of the lands division at criterion of the purposed use in Ukraine in the system of the contemporary land law. Based on the analysis of Ukrainian legislation norms, land law theory sources and the foreign experience dedicated to regulation of similar legal relations the author has come to conclusion that the division of lands of Ukraine into categories at the purposed use which is fixed in the land legislation of the Ukraine does not fulfil the tasks having been made initially, contains numerous system contradictions. The system of the division of lands of Ukraine into categories at the purposed use does not fit with existent economic and historical conditions; the division of lands into categories at the purposed use in Ukraine must be totally abolished. The cancellation of the division of lands into categories at the purposed use should not result in complete disappearance of territories with the specific legal status of land use. Such limitations should be fixed in town-planning documents by means of planning and zoning, to have certain territorial character and stable nature and to be well-known and comprehensible for all interested persons.
