The dissertation focuses on the research of theoretical and practical problems of prosecutor's participation in criminal proceeding of reviewing judicial decisions. The issue of formation of the institute of prosecutor's participation in criminal proceeding of reviewing judicial decisions institute formation is clarified. Taking into consideration the European Court of Human Rights practice, the prospects for further development of judicial decisions review in the system of stages of criminal proceedings are analyzed. Specific features of procedural form are determined and the reasons for initiating the review of judicial decisions in criminal proceedings by the prosecutor are analyzed.
