Essay

In the thesis is examined, on the grounds of academic literature and domestic regulatory legal acts and international legal documents, the legal subject matter of environmental civil rights in Ukraine and the EU. The significance of environmental civil rights for implementation of national environmental policy has been established. It has been ascertained that the regulatory perfection of environmental rights of Ukrainian citizens was carried out and continues to be carried out at three levels: 1) international, universal; 2) international regional, and 3) national, and that of environmental rights of EU citizens – at two levels: 1) the level of EU primary law, and 2) the level of EU secondary law. It has been proposed to differentiate, in the domestic environmental and legal theory, the notions "environmental civil rights" exclusively in objective and subjective meaning and their determination was formulated. The common and specific features in the mechanisms of implementing environmental civil rights in Ukraine and the EU have been shown and a lot of attention given to methods of their protection. The drawbacks in legal regulation of environmental civil rights in Ukraine and the EU were identified and proposals as to their elimination formulated.
