Komarova E. Legal regulation of drawing plots of land of communal ownership into economic circulation

The study presents periodization of the history and development of the legal regime for the lands of communal ownership. It is suggested to resume the category of lands of settlements in the land legislation of Ukraine. The legal status of a territorial community as a subject having the right to the plots of land of communal ownership is specified. The proposals have been worked out to improve the current legislation of Ukraine which determines the order and legal forms of drawing plots of land of communal ownership into economic circulation. The ways to protect the rights of economic entities in the disputes related to the economic use of plots of land of communal ownership have been studied, and the arguments are given why it is important to expand their list fixed in the norms. The ways to protect the rights of subjects of legal land relations, the grounds for and types of their responsibility are identified and specified.
