The dissertation deals with theoretical and practical aspects of ensuring the adoption of legitimate judgments by The Court of Appeals in criminal proceedings of Ukraine. The views on the definition of judgment in criminal proceedings, including the judgment of the Court of Appeal have been analyzed. The reasons and mechanism of making judgments by the Court of Appeals have been examined and approach to the classification of such judgments that have been proposed. The notion of legitimate judgment of the Court of Appeal has been determined and the essence of its formation has been revealed. The existing guarantee of legitimate judgment-making by the appeals bureau has been understood and our approaches have been offered. The suggestions for improving the judgment-making process in order of the appellate retrial have been created.
