Karpuntsov V. Theoretical Basis for Procuracy Functions Formation and Realization: Constitutional and Legal Aspects

The thesis is dedicated to defining the nature and the content of the constitutional functions of the procuracy, the trends of its transformation while taking into account the genesis of formation of international standards of procuracy and practice of implementation of functions of procuracy in Ukraine, identifying weak points in matching sphere of legal regulation and developing propositions to solve them. The research provides a definition of essence of the constitutional functions of procuracy to maintain a public prosecution at court, prosecutorial and judicial representation, prosecutorial supervision over observation the laws by bodies that conduct operational-investigative activity, inquiry and pre-trial investigation, the observation the laws while execution of judicial decisions in criminal matters and the application of other measures of coercion related to the restraint of personal liberty. Particular qualities of implementation of functions by procuracy at the time of transition are defined and analyzed, trend transformations of activity's limits, list and scope of constitutional functions of procuracy are singled out. Legal means of implementation of procuracy's functions are defined and their systematization is made.
