Yakovinets A. Institute of judicial appeal on the stage of pre-trial investigation.

In dissertation research the analysis of institute of judicial appeal is conducted on the stage of pre-trial investigation on the criminal proces legislation of Ukraine. On the basis of study of scientific sources, empiric base, materials of criminal cases, practice of work of investigators, public prosecutor, judge an improvement and addition new normative positions are offered current criminal proces legislation. Certainly, that the institute of appeal according to the кримінально-процесуальним legislation of Ukraine sets procedure of consideration of complaint about violation of judicial, inquisitional actions on the general rules of consideration, and on the special rules the decision of investigator, public prosecutor, judge is examined about laying an action, judicial limitation of rights and freedoms in case of realization of search, detention or taking under the guard of suspected, defendant. The row of new suggestions, conclusions that have a substantial value from theoretical and practice of the criminal rule-making is set forth.
