Essay

Based on the analysis and generalization the thesis reveals and analyzes the procedural provisions of the accused in the current criminal and procedural legislation of Ukraine and judicial practice. It analyzes and systematizes researches of both domestic and foreign scholars on the issue concerning testimony of an accused as a source of evidence in criminal proceedings. General characteristic of the procedural order for involving person as an accused was compiled; the main factors affecting the implementation of right of the accused "to testify or refuse to testify and answer questions" were found.
