Vashchuk Y. Defense lawyer in the administrative and delictual proceedings.

The thesis contains theoretical generalization and the latest disclosure of a scientific problem related to determination and improvement of issues of defense lawyer activity in the administrative and delictual proceedings. The subject of administrative and delictual proceedings was discovered. There was made a conclusion that the defense lawyer in the administrative and delictual proceedings is an independent, self-sufficient member of proceedings under administrative offences, who provides professional legal assistance in accordance with the law to any person, involved to the proceedings under administrative offences by means of protecting his rights, freedoms and legitimate interests. There were determined the principles of defense lawyer activity in administrative and delictual proceedings. There was made a conclusion that the legislation of Ukraine provides a defense lawyer with a wide range of forms and means to protect the rights, freedoms and legitimate interests of clients in administrative and delictual proceedings except for those directly forbidden by law. It was found the peculiarities of defense lawyer activity on the different stages of proceedings under administrative offences. There was investigated the best foreign practices and there was offered a number of changes and additions to the administrative and delictual legislation in this branch.
