Essay

In this research work we have accomplished a rational reconstruction of the philosophical and methodological foundations of B.Kistyakivskyy's legal doctrine in the context of domestic and foreign philosophy and defined their place in the national development of philosophical thought. It was defined that Neo-Kantianism is the philosophical direction, on the basis of which were formed the ideological principles of B.Kistyakivskyy. According to the scientist, Neo-Kantianism is the most effective methodology of studying social processes and phenomena. It is determined that the starting point of his research should be considered the transcendental theory of values proposed by Baden school of Neo-Kantianism. On the assumption of its grounds, B.Kistyakivskyy develops the notion of the essence, which served as a base of the ideological principles of B.Kistyakivskyy. According to the scientist, Neo-Kantianism is the most effective methodology of studying social processes and phenomena of the rule of law, under the condition of which people unite in a political community, moreover, the values and significations are obtained through the collective experience.
