Marahin E. Legal providing of the use of lot lands on the having a special purpose setting

Research object: public relations that arise up at the use of lot lands. Research purpose: development of new theoretical positions of the legal providing of the use of purpose of a land plot and preparation of suggestions on perfection of corresponding legislation. Research methods: system, formal logical, technical legal, structural functional, complex, comparative legal. Theoretical and practical value: theoretical generalization and new decision of scientific task are carried out, which consists in the ground of directions of the legal providing of the use of purpose of a land plot and to preparation of suggestions on perfection of legislation, which regulates relations in this sphere. Separate positions of results are taken into account at planning of measures, sent to providing of the use of purpose of a land plot the "Donetsk metallurgical plant" LTD.; used in practical activity of Management of State communal land-use system in city Donetsk of the Donetsk area and Office of public prosecutor of the Donetsk area at preparation of informative folias in relation to the requirements of current legislation in the landed sphere. Scientific novelty: Juridical features of the legal definition "purpose of the land plot" are offered. The types of purpose of land plots have been studied and developed. The rights and obligations of land owners and land users which provide the use of land plots for the intended purpose are analyzed and generalized; the legal framework for providing the use of land plots for the intended purpose has been explored, and the ways to improve it are offered. The study examines the institutional and legal framework for the use of land plots for the intended purpose and offers how to make it more special. The grounds and procedure of the establishment and change of purpose of land plots are described and completed. The list of restrictions in the use of certain categories of land has been analyzed and updated. The attention is paid to the land-use system in the sphere of providing the use of land plots for the intended purpose, and its functions have been specified. The issues of control over the use of land plots for the intended purpose are analyzed, as well as the legal responsibility for the use of land plots not for the intended purpose. The proposals have been worked out to improve the relevant legislation. Sphere of the use: subjects of legislative initiative; management subjects; higher educational establishments.
