Kakhnych K. Adhesion process as means of crime victim’s rights protection in criminal proceedings.

The dissertation is devoted to the complex study of theoretical and practical problems of compensation of damages caused by the criminal offense in criminal proceedings. In the paper current legislation and the existing scientific attitudes to the institute of adhesion process (civil action in criminal proceedings) are analyzed. The author investigated the concept, essence, the legal nature and significance of the institute of adhesion process. The correlation of the institute with other means of victim’s violated property rights protection is studied. The processes of emergence, establishment of this institution and its implementation and development in the territory of today’s Ukrainian lands are analyzed. The author also made complex research of legislative regulation of the institute of adhesion process under the new Code of Criminal Procedure of Ukraine, and found problems arising in connection with this institution in practice and proposed solutions to those problems. A number of proposals and recommendations aimed at improving the protection of the right of victim of a criminal offense to compensate damages in criminal proceedings are made.
