The thesis studies the procedural status of the suspect and his counsel, the volume of their rights and obligations, guarantees, mechanism of their rights, and some other issues that are essential to ensure the effectiveness of the right to protection under preliminary investigation. Carried out a detailed analysis of the new rules of legal counsel, the suspect and the pre-trial investigation, given the fact that the terms "lawyer" and "suspect" become fundamentally different meaning, new aspects of the interaction of these entities: the order of preventive measures, procedural features of undercover investigative (detective) action and more.
