Kondratenko Y. Legal regulation of land use for urban needs in Ukraine.

Thesis is devoted to the legal regulation of land use for urban needs in Ukraine. We studied the theoretical and practical legal problems of land use for urban development in modern conditions, and the main trends in the development of legislation regulating relations in the field of land use for urban needs. The thesis analyzed the legal regulation of land relations, for which norms of urban law did not cover, land relations in the regulatory process which is an imposing influence norms of land and town planning legislation, as well as relationships that are not directly related to land relations. Installed signs of state control over the use and development of land, provided for urban development, based on the right of public (state or local) authorities, which are carried out regardless of the form of ownership of land. Control functions are carried out by on land resources, environment and architecture and urban planning .Justified position that the implementation of the construction should be based on appropriate legal title, which is defined in the permit for construction of real estate meets the legal regime of the land. On the basis of title buildings can be both right and obligation of the land owner. The classification of procedures for granting land for urban development needs and, depending on the methods of acquiring rights to these plots. Specific proposals for section land allocation for urban planning and development on the two main stages: the decision by the authorized bodies and registration of building exercise.
