Popov D. Philosophical-Juridical Basis of the Application of Natural Law in the Exercise of a Judicial Discretion

The dissertation provides a comprehensive scientific study of the philosophical-juridical basis of the use of natural law in the exercise of a judicial discretion. A philosophical-juridical analysis of the history of the formation and development of ideas about the use of natural law in the exercise of a judicial discretion was done. The content of natural law as natural rights and duties of a person whose basic concept is the concept of inalienable human dignity was considered. Different views of holding a judicial discretion are studied. The place of natural law is reflected in the declared principle of the rule of law and its application in the exercise of a judicial discretion.
