Bayrak D. Legal regulation of trade secrets in labor relations.

The thesis is actually a first attempt of comprehensive assessment of the state regulation of trade secrets in labor relations. The author analyzes the legal nature and features of this regulation, a place of trade secrets, among other types of classified information. Central and local regulation of the use of trade secrets is considered in detail, also special attention is paid to the confidentiality agreement (non-disclosure) - a key element of local control. Historical and comparative analysis of domestic and foreign laws regarding trade secrets institute is done, the best foreign standards, suitable for implementation in national legislation are determined. The mechanism of protection of trade secrets is considered, which is the most rational form and way to protect trade secrets in the context of labor relations. The detailed analysis is given of criminal, civil and disciplinary responsibility for unlawful acts concerning the legal regime of confidential data, the existing problems and priority areas of perfecting the mechanism of protection of trade secrets in labor relations, and making changes in the draft Labor Code.
