In dissertation investigational theoretical and practical aspects of normative regulation of realization in form private prosecution. Analysed scientific positions in relation to understanding of prosecution as institute of criminal judicial right, his concept, maintenance and functional setting. Legal nature of public prosecution is considered as a double category to the article of this dissertation research. Essence of the phenomenon of private prosecution is in detail studied, changes are analysed, that brought in new KPK in this legal institute. The features of normative regulation of realization are intelligent in form private prosecution on the pre-trial and judicial stages of criminal process, found out the existent lacks of normative regulation, complications in practice and suggestions are formulated in relation to the decision of the noted problems.
