This research is focuses on the institution of the judiciary in the concept of separation of powers at the present stage of judicial reform in Ukraine. The paper analyzes the theoretical and methodological principles of separation of powers as a basic principle of modern constitutional state. In addition, there are investigated the historical aspects of the concept of powers distribution, as well as the international experience of determining judiciary in systems of government distribution is researched, as well as the place and role of the judiciary in the mechanism of "сhecks and balances" in the system of power distribution. Special emphasis is made on the analysis of the current state of the judiciary in the system of power distribution and its interaction with other branches of government, as well as major tendencies of the development of judicial control at the current period of the national judicial system functioning are determined.
