The thesis presents a comprehensive analysis of the development and provisions of theoretical and practical problems concerning the implementation of judicial control over the observance of the right to respect for private life in the criminal proceedings. The work reveals the nature of judicial review, offered his definition. Focus on signs, forms and types of judicial control system to operate the specific grounds investigating judge signs the investigating judge as the subject of criminal and procedural activities. The essence of the right to respect for private life in the criminal proceedings, formulated his concept defined subjects of the right to respect for private life in the criminal proceedings and the entities that provide compliance with this law. The essence of restrictions on the right to respect for private life, formulated his concept defined objective conditions of lawful restrictions on the right to respect for private life of the criminal proceedings. The mechanism of judicial control over the observance of the right to respect for private life during the application of preventive measures; investigative (detective) and covert investigative (detective) action in appealing decisions, acts or omissions during the preliminary investigation determined the powers of an investigating judge in the exercise of such control. As a result of the study and synthesis of international experience, investigative and judicial practices, analysis of existing legal and regulatory provisions made evidence-based recommendations for improving the mechanism of judicial control over the observance of the right to respect for private life.
