Thesis deals with the philosophical and legal basis for implementation of human right to defence based on ukrainian and foreign experience. The author analyzed a comprehensive description of the philosophical and legal nature of the human right to defence realization, and it lets him to draw some conclusions and make appropriate suggestions. The right to defence was examined as a part of human existence at the level of theological, evolutionary and synergetic theories of philosophy. There was formulated the provision that from philosophical and legal positions the right to defence can be considered as administration of justice in each real-life situation. The jurisdictional and not jurisdictional forms of realization of human right to defence are analysed taking into account ukrainian and foreign experience.
