Essay

Dissertation is aimed to make a complex analysis of theoretical legal and procedural aspects of participation of an interpreter in the criminal proceedings. The experience of foreign countries as to procedural status of an interpreter as a participant of the criminal proceedings has been analysed; the notion, the criteria and procedural status of an interpreter in the criminal proceedings of Ukraine has been defined; the necessity of legal fixation of the single ground for the participation of an interpreter on the criminal proceedings – having no command of the language of the criminal proceedings – has been suggested. On the basis of the legislation in action and scientific works of scientists in the field of criminal procedure the issue of involvement of an interpreter in the criminal proceedings, his participation in investigative actions, and also the issue of compulsory translation of procedural documents and giving them to the participants of the criminal proceedings has been studied in detail. The procedure and specific features of participation of an interpreter during trial, proceedings in the court of appeal, court of cassation and the Supreme Court of Ukraine have also been analysed. As a result of the research certain propositions which are aimed at the improvement of the criminal procedural legislation in the part that regulates procedural status of an interpreter during pretrial investigation and court proceedings have been formulated.
