Shylenko M. Administrative and legal protection for small business entities.

The study is devoted to the problem of determining the concepts and features and of administrative and legal protection to small businesses in Ukraine. This set of administrative and legal elements of administrative protection. It is made by a combination of static and dynamic activities of public administration based on the norms of administrative law. Small business as an object of administrative protection is revealed. These subjects of small business are analyzed from the perspective of the theory of administrative law, current laws of Ukraine and research of scientists. The peculiarities the subjects of small business as an object of administrative protection are formulated. The definition of concept administrative status of public administration, which carries protection the subjects of small business is determined. The administrative status of the Ministry of Economic Development and Trade of Ukraine and the State Service of Ukraine for Regulatory politics and development of entrepreneurship are analyzed as leading subjects of public administration, which carries protection the subjects of small business. Using the comparative method in the analysis of national legislation and legislation of foreign countries to identify common features and differences of administrative and legal protection of small business are investigated. The purpose of this investigation is to study their experience and implement it in national terms. The ways of state support as a form of protection of small business is studied and main рowers of public administration are discovered. The lacks of the administrative and legal protection of small business are opened. Recommendations relating to the improvement of legislation and legal regulation of entrepreneurial activity are formulated. The research paper contains proposals and addings to the current legislation in the sphere of individual enterprise.
