Serdiuk O. Legal basics of using groundwater.

Dissertation is devoted to the comprehensive study of the legal basics of using groundwater. It has been analyzed historical and international legislations and its development in this law field. It has been researched the legal nature of groundwater and its place in the system of natural groundwater and subsoil objects has been defined. Features of the general and special nature use when using groundwater have been highlighted. Procedures of acquisition and termination of a right of using groundwater have been considered in details, specifics of realization of this right have been analyzed as well. Problems of attraction to legal responsibility for violation of the legislation when using groundwater have been revealed. Based on the research, exclusion of groundwater from minerals has been offered and the recommendations on improvement of the legislation that regulates using groundwater have been developed.
