Stolbovyy Y. Principle of Official Finding of Facts of the Case in Administrative Legal Proceedings of Ukraine

The paper is dedicated to study of principle of official finding of facts of the case in administrative legal proceedings of Ukraine. The concept, the attributes and the intentions of principles of administrative legal proceedings are disclosed. The system of principles of administrative legal proceedings is put under analysis and the place of the principle of official finding of facts of the case in said system is clarified. The genesis, the concept and the essence of principles of equality, competitiveness and discretion are cleared up as well as their correlation with the principle of official finding of facts of the case. The mechanism of realization of said principle in Ukrainian administrative legal proceedings is disclosed as well as the same on different stages of administrative procedure. Court practice with regard to administration by the courts of the principle of official finding of facts of the case is analyzed as well as juridical errors therein are disclosed. Changes to law in effect are suggested to improve legal relations with respect to realization of the above-said principle.
