Rakhnianska T. Legal regime of lands of capital construction (environmental and legal principles).

The thesis is the complex research of doctrinal provisions of theory of law, ecological and land law, current Ukrainian legislation, norms of international and European law and legislation of foreign countries as to peculiarities of legal regime of lands of capital construction and its ecological and legal principles. The paper justifies the legal definition of lands of capital construction, the legal regime of lands of capital construction, identifies legal features of legal regime of lands of capital construction, ecological and legal principles of legal regime of lands of capital construction; also the paper explores the mechanisms of legal regime of lands of capital construction, which includes institutional and functional systems of legal organization of lands of capital construction usage, determines peculiarities of ecological management and legal responsibility for offenses in the field of lands of capital construction usage and protection. In order to "green" capital construction and eliminate shortcomings of the legal regulation of social relations in the field of lands' of capital construction usage and protection the author proposes the number of amendments to current legislation of Ukraine.
