Essay

In the dissertation scientific-theoretical positions, the legislation of domestic and international level concerning an establishment and improvement of protection of organic goods from genetically modified organisms in Ukraine with allocation of aspects of the subsequent practical application are researched. It is considered theoretical legal and juridical principles of protection of organic goods from use of genetically modified organisms which include circulation in determination of genetically modified organisms, presence of the analysis of risks, history of creation, realization of classification, a prediction of corresponding kinds, institutes, allocation future directly industry allocation «the biotechnological right», the analysis of the acting domestic and international standard legal base with its detailed analysis, the subsequent tendencies of settlement, regulation of stages of selection, in thremmatology, during agriculture and protection of plants, a prediction of the maintenance of plenary powers of proper subjects and criminal liability application. The scientific-theoretical analysis of features of introduction, accomplishment, settlement of process of organic production, goods, and its elements is performed, reasoning from integrated approach and dynamics of changes. On the basis of the conducted analysis the offers directed on increase of efficiency of introduction, distribution, accomplishment organic productions, reduction of application of genetically modified organisms, nature preserving, in whole and the rights and freedom of the person, the citizen are developed.
