Artemenko O. Evidence in criminal proceedings on acts committed by mentally defective persons

Thesis provides a comprehensive analysis of evidentiary process in criminal proceedings on acts committed by mentally defective persons. "Evidence" and "fact at issue" concepts have been improved; a target of evidence regarding the acts committed by mentally defective persons has been defined. An event of socially dangerous act has been studied; commitment of socially dangerous acts by mentally defective person has been detected; conditions have been proposed which characterize a person and his/her mental disease. Special aspects of evidence have been defined in proceedings on acts committed by mentally defective people at the stage of preliminary investigation, at a court of first instance, at a court of appeal and cassation instance.
