The dissertation is dedicated to the study of the concept, content and mechanism of the implementation inviolability of ownership as general principle of criminal proceedings. The author discloses the concept of the principle of inviolability of ownership in criminal proceedings, analysis of international and foreign experience of ensure foreign during criminal proceedings. On the basis of the current legislation and scientific works of forensic scientists the mechanism of the implementation of the principle of inviolability of ownership during the criminal proceedings is uncovered, the grounds and procedure of compensation damage, caused by unlawful deprivation or restriction of ownership during criminal proceedings is investigated, and procedure of recovery of ownership of illegally citizens is convicted. By the results of the investigation the proposals to improve the Criminal Procedure Law in the part that regulates the implementation of the principle of inviolability of ownership are made.
