Rushynets I. Paying damages as a remedy to protect rights to land.

The Thesis is devoted to the comprehensive research of paying damages as a remedy to protect rights to land. Twofold legal significance of paying damages institute is established: as a remedy and a legal guarantee of land rights. The definitions of damages caused to land owners and land users, violation as a ground for paying damages, paying damages as a remedy to protect rights to land etc. are proposed. The damages caused to land owners and land users and other adjacent categories (damage, loss of agricultural and forestry production) are differentiated. Scientific conclusions in relation to paying damages as a remedy to protect rights to land are drawn, the propositions concerning improvement of current legislation and settlement of problematic issues of practice are made.
