Derev'yanko M. The guarantees of rights and freedoms in the application of preventive measures such as custody

During the exploring the procedural peculiarities of guaranteeing of individual rights and freedoms in the application of a preventive measure in the form of custody, it was identified the shortcomings of the legal regulation and implementation. From the point of view of the theory and practice it was outlined the grounds, conditions and reasons for the application of the preventive measure in the form of custody, analyzed the order of its application, investigated the role of the court as a guarantor of the application of a preventive measure in the form of custody. From the standpoint of international standards and practice of the European Court of Human Rights, in accordance with Article 5 of the European Convention on Human Rights, the dissertation analyzes the domestic law enforcement in order to implement the ensuring of the rights and freedoms in the process of application of custody as a preventive measure, as well as the paper studies the rights and freedoms through the issue of their implementation in the current Ukrainian criminal procedural law.
