Mazurkov D. Investigations on illegal purchasing, sales, or use of special technical means of surreptitious obtaining of information.

Based on the conducted research and summarization of the data from the practical operations of the investigatory force of the Ukrainian Security Service a number of theoretical provisions and practical recommendations concerning the pre-trial investigation of a certain type of crimes have been developed. The present dissertation elucidates the process of establishment and formation of a concept of special technical means of surreptitious obtaining of information and determination of criminal responsibility for their illegal circulation; throws light upon certain elements of forensic description of crimes, provided for in Article 359 of the Criminal Code of Ukraine, and shows correlation between them; defines and characterizes typical situations; shows peculiarities of arrangement and planning of investigations at their initial stage, examination of the scene of actio, examination of belongings, search, interrogation, use of expert's assistance by the investigator and commissioning and performance of a forensic expert assessment on the special technical means during the pre-trial investigation. The present dissertation also proposes an author's definition on the special technical means for surreptitious obtaining of information and recommendations on the use of special knowledge and expert's assistance by the investigator.
