Karpenko M. Administrative and Legal Regulation of the Activity of the Security Service of Ukraine

The object of research:public relations, arising in the activities of the Security Service of Ukraine. The aim of the thesis: to determine the nature and characteristics of administrative and legal regulation of the Security Service of Ukraine activity, to provide scientifically based propositions for its optimization. Methods: A set of methods and techniques of scientific knowledge: the ascent from the abstract to the concrete and logical-semantic, comparative legal and information ones and methods of classification, grouping, system-structural ones, systemic-functional method and other. Scientific novelty: for the first time it is characterised the administrative and legal regulation of activity of the Security Service of Ukraine as a system, set up such features as (systematic, purposeful character, availability of appropriate subject matter and scope of legal enforcement, the use of administrative and legal method of regulation, ordering and organizational nature, stages, etc.) Determined are the main trends of further development of administrative and legal regulation of activity of the Security Service of Ukraine to be necessary for considering at reforming of law enforcement bodies; The peculiarities of the management bodies of the Security Service of Ukraine are considered, reasonable division of management bodies of the Security Service of Ukraine on the external and internal management is pointed out, as a result it is made a conclusion that the Anti-terrorist Centre of the Security Service of Ukraine is a subject of external control; The essence of staffing of the Security Service of Ukraine and its features associated with the structure of the body, and the state of administrative and legal regulation are determined, outlined are the ways of improving of the latter. Practical value: the results of the research can be used: in the research area - the main provisions and conclusions of the thesis can be the basis for further development of ways to optimize administrative and legal regulation of activity of the Security Service of Ukraine; in law making – the research has formulated a number of proposals for amendments and additions to laws and regulations, provisions regulating the activity of the Security Service of Ukraine; in enforcement activity – use of the results will improve the effectiveness of the Security Service of Ukraine, to bring it in line with modern European standards. Scope: thesis and conclusions may be used at preparing of textbooks and manuals on subjects «Administrative Law», «Judicial and law enforcement bodies of Ukraine», «Protection of rights and freedoms in law enforcement bodies».
