Topolya R. Administrative and legal regulation of expertly-criminalistics researches of transport vehicles.

The thesis provides conceptual synthesis and new solution to the scientific task of identification and improvement of matters associated with administrative and legal regulation of expertly-criminalistics researches of transport vehicles. Expertly-criminalistics researches of transport vehicles have been studied as an object of administrative and legal regulation. It has been found that object of administrative and legal regulation of expertly-criminalistics researches of transport vehicles is the right drivers and other road users to conduct legal, independent, impartial and full forensic examination of vehicles and registration documents accompanying, on the basis of the special knowledge of vehicle and registration documents, and also organizational and legal activities of the public administration regarding support of experts and expert institutions that research vehicles and registration documents accompanying. Administrative and legal status of the public administration has been researched. The principles for administrative and legal of expertly-criminalistics researches of transport vehicles have been identified. The author revealed the concept and content of the mechanism of administrative and legal regulation of expertly-criminalistics researches of transport vehicles; forms and facilities of administrative activity of public administration in the field of expertly-criminalistics researches of transport vehicles; administrative procedures of expertly-criminalistics researches of transport vehicles. Areas for improvement of the legislation and administrative activity of public administration in the field of expertly-criminalistics researches of transport vehicles. Special aspects of the best foreign practices have been identified, and multiple amendments have been proposed to administrative and legal rules in this area.
