Essay

The thesis is devoted to research of theoretical and methodological problems associated with the investigation of obstructing the lawful professional activities of journalists. Formulated and recommendations aimed at solving important scientific and practical problem is the formation of the conceptual foundations of a technique of investigation of obstructing the lawful professional activities of journalists, and the findings determine the prospects of scientific support for combating crime and training for law enforcement. The thesis based on the study of scientific papers on criminology, operative-investigative activities, criminal procedure, criminal law and other branches of law, national legislation, summarizing the practice of its implementation carried out a comprehensive analysis of the theoretical and practical foundations of the investigation of obstructing the lawful professional activities of journalists. In particular, the formulated criminological characteristics of obstructing the lawful professional activities of journalists; revealed organizational basis of the initial stage of the investigation of such crimes. In addition, the recommendations on the organization and conduct of certain investigative (search) action at the initial stage of the investigation of crimes under art. 171 of the Criminal Code of Ukraine. Considerable attention given to forensic characterization of obstructing the lawful professional activities of journalists as a basis for constructing techniques of their investigation. The main structural elements of criminological characteristics of these crimes the author include: the situation of the crime; modus operandi; especially traces of criminal activity; personality characteristics typical of the perpetrator; especially the motivation of those responsible; a typical characteristic of the victims.
