Saparova A. The Borrowings in Law: Philosophical-methodological Grounds

The thesis is a comprehensive scientific research on the philosophical- methodological grounds of legal borrowings. The legal borrowings have been considered as a basic problem of European legal thinking, and they are analyzed from the point of view universality or singularity of legal meaning. The presentation of borrowings in law as the object of Comparative Law allowed to constitute the methodological originality of it. It have been substantiated that the research of legal transplants as a comparative-legal notion of borrowings in law, necessarily forms the new methodology of its research, which founded on negation as legal positivism and natural law.
