Essay

The scientific research work is dedicated to disclose the concept of inviolability of property rights, determine its essence and integrity features, examine the genesis of specified principles and its correlation with other principles aimed at protection of property rights. The principle of inviolability of property rights have been studied by court decision and without; defined the circle of mandatory and optional participants in criminal proceedings which carry out procedural actions aimed at compliance with this framework and take a direct part in it. The factual and legal grounds, procedural order of application of measures to ensure the criminal proceedings, a series of investigative (detective) and covert investigative (detective) actions that included potential deprivation or restriction of property rights are analyzed. The proposals on the implementation of the principles of inviolability of property rights during a series of proceedings when there is deprivation or restriction of property rights have been suggested.
