The general characteristic is given to the principles of criminal proceedings, a story of development of science of criminal trial about legality in criminal proceedings is investigated, the concept and essence of the principle of legality of criminal proceedings are defined, analyzed a procedural form of pre-judicial production as a necessary condition of law enforcement, subjects of law enforcement, violation of the law and their legal consequences, and also special legal guarantees of law enforcement in pre-judicial criminal proceedings. Evidence-based changes and additions to the existing criminal procedural legislation of Ukraine are offered.
