Solodkov A. Theoretical foundations and practice of the realization of a jury trial proceeding in Ukraine.

On the basis of comparative-legal approach of modern world models of jury trial its significal features are determined; conclusion concerning its conformity to the only legal nature of the anglo-saxon model (traditional) is proved. Jury trial proceeding is investigated according to the legislation of Ukraine; legal status of a juror is characterized; peculiarities of the process of formation of a jury trial and consideration of the criminal proceeding; factors which influence the formation of the sense of justice and moral certainty of a jury are revealed and studied. On the basis of the analysis of the jury trial practice, taking into the account ECHR legal opinions and the investigated scientific approaches, propositions referring to the improvement of the going legislation of Ukraine acting in part which regulates the legal status of a juror and the process of the jury trial.
