Chekavska J. Legal Basis of Environmental Management Systems Implementation in Ukraine

The dissertation deals with the integrated research of the legal basis of environmental management systems implementation in Ukraine. In this research, the place of legal regulation of environmental management and its systems functioning in the system of modern environmental law is determined. The author conducts the legal-theoretic research in the field of organization of environmental administration and environmental management, as well as investigates the legislative approaches to the definition of the examined legal category. The concept and distinctions of the legal regulation mechanism of environmental management systems implementation are determined, along with its composition: organizational-legal forms of implementation; the functions of environmental management; the system of legal motivations for business entities for environmental management systems implementation. In virtue of executed research, the suggestions on the current legislation improving in the sphere of environmental management systems implementation are developed, and the theoretical conclusions that could be used for further development of national environmental law are proposed.
